Vasilas v. Subaru, 07-cv-2374 S.D.N.Y. (GRB)

Hinckley & Heisenberg has negotiated a settlement of its suit against Subaru of America, Inc. and others, which alleged that defendants violated the Federal Odometer Act by designing Subaru odometers that overstate the actual mileage traveled, thereby prematurely exhausting the vehicle's warranty coverage and causing lessees to incur excess mileage charges.
Under the settlement, Subaru will extend the existing warranties by 5% for the 2003 to 2007 model year Subaru vehicles. Subaru also will reimburse vehicle owners and leasees for certain prior repair or lease expenditures.
On June 28, 2010, the United States District Court for the Southern District of New York (Judge George B. Daniels) granted preliminary approval of the settlement.
